Introduction and Acceptance
These Terms and Conditions ("Terms") are a binding agreement between you ("Customer," "you," or "your") and DashCloud LLC, a limited liability company registered in the State of Wyoming, USA, doing business as DashRDP ("DashRDP," "we," "us," or "our"). These Terms govern your access to and use of dashrdp.com, our client billing portal, and all hosting and remote access services we operate, including Private Windows RDP, Dedicated Servers, Residential RDP, Linux VPS, and VPN services (collectively, the "Services").
By creating an account, placing an order, or using any Service, you agree to be bound by these Terms, along with our Privacy Policy, Acceptable Use Policy, and Refund Policy, each of which is incorporated into these Terms by reference. If you do not agree with any part of these Terms, you must not access or use our Services.
If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case "you" and "your" will refer to that entity.
Our Services
DashRDP provides cloud infrastructure and remote access solutions, including:
- Windows and Linux RDP hosting with dedicated, isolated resources
- Residential RDP services that route traffic through residential or ISP-assigned IP addresses for geo-specific access
- Scalable Linux VPS plans, including NVMe storage options
- Dedicated server hosting across multiple global data centre locations
- Pre-configured VPN services using OpenVPN and WireGuard protocols
- 24/7 technical support via ticket and live chat
- DDoS mitigation and standard network security infrastructure
Exact specifications, included bandwidth, server locations, and features for each plan are described on the relevant product page at the time of purchase and form part of your order. We may update hardware, network routes, IP pools, or specific plan features over time to maintain performance, security, and service quality, provided the core service you purchased is not materially reduced without notice.
Account Registration and Security
You must provide accurate, current, and complete contact and billing information when registering for an account. You are solely responsible for safeguarding your account credentials, API keys, and any server or RDP access details issued to you. All activity that occurs under your account is your responsibility, whether or not you authorized it.
You agree to:
- Use a strong, unique password for your client account and your servers
- Notify us immediately at support@dashrdp.com if you suspect unauthorized access or a credential compromise
- Not share account login credentials with third parties, except where reasonably required for your own internal operations
- Keep your billing and contact information current to avoid missed renewal notices or service interruption
We reserve the right to request identity or payment verification before provisioning or continuing to provide Services, particularly for high-risk products such as Residential RDP, where we may apply Know Your Customer (KYC) checks at our discretion to limit fraud and abuse.
Billing, Renewal, and Payment
Fees are billed in advance based on the billing cycle you select at checkout (monthly, quarterly, or annual, depending on the product). We accept major credit and debit cards, PayPal, select cryptocurrencies, and other regional payment methods displayed at checkout through our billing system.
- Recurring services renew automatically at the then-current price unless cancelled by you before the renewal date through your client portal
- If a renewal payment fails, we will attempt to notify you and may apply a grace period as stated on your invoice before suspending the affected service
- Prices displayed exclude applicable taxes, duties, or levies unless explicitly stated otherwise; these may be added at checkout based on your billing location
- We reserve the right to change pricing for future billing cycles with reasonable advance notice; price changes do not apply retroactively to a cycle you have already paid for
- Chargebacks or payment disputes filed without first contacting our support team may result in immediate suspension of all services on your account pending investigation
Refunds
Most DashRDP products are eligible for a refund if requested within 7 days of initial purchase, provided the service has not been subject to abuse, excessive resource use, or a violation of our Acceptable Use Policy. Certain products, including custom-configured dedicated servers, Residential RDP plans, and renewal payments on existing services, may be non-refundable or subject to different conditions, as noted on the product page at checkout.
Approved refunds are issued to the original payment method where possible, or as account credit where the original method cannot be refunded (e.g. certain cryptocurrency or regional payment methods).
This section is a summary only. Full eligibility rules, timeframes, and exclusions for every product are set out in our Refund Policy, which governs in the event of any conflict with this summary.
Acceptable Use
You must comply with our Acceptable Use Policy at all times when using any DashRDP Service. Without limiting that policy, you must not use our Services to:
- Host, distribute, or transmit illegal content under applicable law
- Distribute malware, ransomware, viruses, or other malicious code
- Send spam, unsolicited bulk communications, or conduct phishing
- Infringe copyright, trademark, or other intellectual property rights
- Mine cryptocurrency without our prior written approval
- Conduct DDoS attacks, port scanning, or unauthorized network intrusion attempts against any third party
- Engage in credential stuffing, account takeover attempts, or unauthorized automated login activity against third-party platforms
- Abuse shared system resources in a way that degrades service for other customers
- Violate the terms of service of any third-party platform, website, or application accessed through our Services
Violations may result in immediate suspension or termination of the affected service without refund, and we may report unlawful activity to relevant law enforcement or regulatory authorities. We reserve the right, but are not obligated, to monitor account activity for AUP violations, and we may remove or disable access to content that we reasonably believe violates law or these Terms.
Residential RDP and Proxy-Based Services
Our Residential RDP service routes outbound network traffic from your virtual desktop through residential or ISP-assigned IP addresses, sourced through commercial network partners, to present a residential-style network identity rather than a datacenter IP. This section applies specifically to that service, in addition to all other sections of these Terms.
No guarantee of platform access.
DashRDP does not control how third-party websites, platforms, marketplaces, advertising networks, financial services, or social media services detect, score, block, or restrict residential or proxy-originating traffic. We do not guarantee that any specific platform will allow, recognize, or maintain access for traffic routed through our Residential RDP network, and we are not responsible for account suspensions, bans, restrictions, or access denials imposed by third-party platforms as a result of your use of the Service.
Customer responsibility for use.
You are solely responsible for ensuring that your use of Residential RDP complies with applicable law and with the terms of service of any website or platform you access through it. Prohibited uses under this service specifically include, without limitation: credential stuffing or brute-force login attempts, creation of fake or fraudulent accounts at scale, ad fraud or click fraud, bypassing payment, identity, or fraud-prevention controls, unauthorized scraping that violates a target site's terms or robots directives, and any activity intended to evade detection systems for the purpose of facilitating fraud or abuse against a third party.
Network sourcing.
Our residential IP pools are sourced through commercial, consent-based network partners. We do not knowingly source IPs from compromised devices, malware, or non-consensual bandwidth-sharing arrangements. IP availability, location coverage, and rotation behavior may change at any time based on upstream network partner availability and are not guaranteed to remain static.
Liability for misuse.
You agree to indemnify and hold DashRDP harmless from any claim, penalty, fine, or third-party demand arising from your misuse of Residential RDP, including claims brought by a platform whose terms of service you violated using the Service. We may suspend or terminate Residential RDP access immediately and without prior notice upon any reasonable suspicion of abuse, with no entitlement to a refund for the affected billing period.
VPN Services (OpenVPN / WireGuard)
DashRDP offers pre-configured VPN access using the OpenVPN and WireGuard protocols on supported VPS plans. These VPN services are provided for legitimate purposes such as securing remote connections, encrypting traffic over untrusted networks, and accessing your own infrastructure remotely.
You agree not to use our VPN services to violate any applicable law, to circumvent legal restrictions in a manner prohibited by your jurisdiction, or to engage in any activity prohibited under Section 6 (Acceptable Use) of these Terms. We do not log VPN browsing content, but we may retain limited connection and billing metadata as necessary to operate, secure, and bill for the Service, as described in our Privacy Policy. VPN configuration files and credentials issued to you are for your use only and must not be resold or redistributed without our written consent.
Service Level Agreement (Uptime)
DashRDP targets 99.9% monthly network uptime for production RDP, VPS, and Dedicated Server services on eligible plans, excluding scheduled maintenance, which we will announce in advance where practicable, and excluding outages caused by factors outside our reasonable control (see Section 12).
If documented downtime on an eligible plan exceeds the committed monthly threshold, you may be entitled to a service credit calculated against the affected service's billing value for that period. SLA credits are issued as account credit toward future invoices, not as cash refunds, and must be requested through a support ticket within 14 days of the qualifying outage. SLA credits do not apply to Residential RDP services, where uptime depends in part on third-party network partners outside our direct infrastructure.
Customer Data and Backups
You retain all ownership rights to data, files, and content you store on your server. You are solely responsible for maintaining your own backups of that data unless you have separately purchased a managed backup add-on from us.
DashRDP is not liable for data loss resulting from your own actions, misconfiguration, third-party software you install, force majeure events, or your failure to maintain independent backups. We may access your server in limited circumstances for troubleshooting at your request, to investigate a suspected Acceptable Use Policy violation, or as required by law, and we will remove content that we reasonably believe violates applicable law or these Terms.
Suspension and Termination
We may suspend or terminate any Service, with or without notice depending on severity, for: non-payment after the applicable grace period, violation of our Acceptable Use Policy, abuse reports from third parties or upstream network providers, suspected fraud, or as required to comply with a legal or regulatory request.
You may cancel any Service at any time through your client portal. Cancellation stops future billing for that service but does not, by itself, entitle you to a refund for fees already paid; refund eligibility is governed by Section 5 and our Refund Policy. Upon termination, you are responsible for retrieving any data from your server prior to deprovisioning; we are not obligated to retain or provide data after a service is terminated, and access to deprovisioned servers cannot be restored.
Limitation of Liability and Warranties
Our Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or fully secure against unauthorized access.
To the maximum extent permitted by applicable law, DashCloud LLC's total aggregate liability for any claim arising out of or relating to these Terms or your use of the Services shall not exceed the total fees paid by you for the affected Service in the twelve (12) months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.
We are not liable for failures or delays caused by events outside our reasonable control, including upstream network or carrier outages, internet backbone disruptions, third-party data centre failures, natural disasters, government action, or denial-of-service attacks directed at our infrastructure or yours.
Indemnification
You agree to indemnify, defend, and hold harmless DashCloud LLC, DashRDP LLP, and their respective officers, employees, and affiliates from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of or related to: your use or misuse of the Services, your violation of these Terms or our Acceptable Use Policy, your violation of any third-party platform's terms through Residential RDP or otherwise, or your violation of any applicable law or third-party right.
Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict-of-law principles, regardless of your country of residence or the country from which you access the Services.
Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved informally by contacting support@dashrdp.com. If a dispute cannot be resolved informally within 30 days, it shall be subject to the exclusive jurisdiction of the state or federal courts located in Wyoming, USA, and you consent to personal jurisdiction in those courts.
Changes to These Terms
We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. Material changes will be posted on this page with a revised "Last updated" date, and where changes are significant, we may additionally notify active customers by email. Your continued use of the Services after a change takes effect constitutes your acceptance of the revised Terms.
